The majority of our expert witness Cases involve some aspect(s) of insurance bad faith and/or deceptive trade practices.

Basis of Bad Faith Allegations

Allegations of insurance bad faith dealings are usually based on the insurance statutes of each state.  While statutory language varies for each state, insurance bad faith laws usually reference:

  • Breach of contract
  • Misrepresentation of policy or insurer
  • Misrepresentation of a material fact
  • Failure to disclose a material fact
  • Failure to promptly settle claims
  • Unfair or deceptive trade practices
  • False statements / False advertising

Since entering the insurance industry in 1973, Mr. Daniel has seen acts of insurance bad faith committed by agents, carriers, and insureds.  He has seen cases where bad faith actions were readily evident, as well as cases where allegations of insurance bad faith had no basis in fact.

September 2005 - Engaged to assist defense attorneys answering alleged Agent Errors & Omissions. A fireworks explosion and fire resulted in multiple fatalities and widespread property losses.
